Terms of Service
Welcome
Thanks for stopping by Cottage Art & Design. Throughout this page, "we", "us" and "our" mean Cottage Art & Design ("the Business", trading as Carroll Creative Arts Ltd. We run this website and shop, along with everything on it - the products, content, features and services we offer you (together, "the Services") - to give you a proper, personal shopping experience rooted in botanical art and countryside life. Our site is built and hosted on Wix, which powers the technical side of things behind the scenes.
These Terms of Service, alongside any policies they refer to, set out how the relationship between us works when you use the Services. They're a bit dry in places, as these things tend to be, but they matter - they cover things like liability and your rights as a customer, so it's worth a proper read.
By browsing, shopping with, or otherwise using the Services, you're agreeing to these Terms and to our Privacy Policy www.cottageartanddesign.com/privacy-policy. If you'd rather not agree to either, please don't continue using our Services.
Who Can Use the Site
By agreeing to these Terms, you're confirming you're old enough, under the law of the country you live in, to enter into this kind of agreement - and that if any children in your household use the Services on your devices, you've given your permission for that.
To browse, order, or otherwise use the Services, we may ask for details such as your email address, billing information, payment details and shipping address. You're confirming that whatever you give us is accurate, up to date and complete, and that you're entitled to share it with us.
Keeping your account details secure is down to you, as is anything that happens under your account. Please don't pass on, sell, or share your account with anyone else.
Our Products
We do our best to represent our artwork, prints, wallpaper and other products accurately, but do bear in mind that colours and finishes can look slightly different depending on your screen and device settings - watercolour in particular doesn't always translate perfectly to a monitor.
We can't promise that a product will look or feel exactly as pictured once it arrives, though we always aim to get as close as possible.
Product descriptions may be updated from time to time, and we may discontinue a design or limit how much of it is available, at our discretion.
Placing an Order
When you place an order with us, you're making us an offer to buy - it isn't confirmed until we accept it, which happens once your payment has gone through successfully. Please check everything carefully before you check out, as we may not always be able to change or cancel an order once it's been placed. If we're unable to accept, need to amend, or have to cancel your order, we'll get in touch using the email, billing details or phone number you gave us.
Any returns or exchanges are handled in line with our separate Refund Policy www.cottageartanddesign.com/refunds-and-returns.
Orders placed with us are understood to be for your own personal use, rather than for resale or commercial purposes.
Pricing and Payment
Prices, offers and discounts can change without notice. You'll pay whatever price is shown at the time you place your order, as confirmed in your order confirmation email. Unless we say otherwise, prices don't include taxes, shipping, or any customs and import charges that may apply - particularly for orders heading outside the UK.
Prices on the website may differ from those at markets, fairs, or other places we sell. From time to time we may run promotions with their own separate terms; where those conflict with this policy, the promotion terms take priority.
Please keep your account and payment details current and accurate, so we can process your order and get in touch if needed. By placing an order, you're confirming that your payment details are genuine, that you're authorised to use them, and that you'll cover the cost of your order, including shipping and any applicable taxes.
Shipping
Delivery times are estimates, not guarantees, and we can't be held responsible for delays caused by couriers, customs, or anything else outside our control. Once your order has left us and been handed to the courier, responsibility for it passes to you. For fuller detail on shipping windows and locations we cover, please see our Shipping Policy www.cottageartanddesign.com/shipping-policy.
Our Designs and Content
Everything you see across the Services - our artwork, branding, photography, product images and written content - belongs to Cottage Art & Design, or is used with permission, and is protected by copyright and other intellectual property law.
You're welcome to enjoy and browse this content for your own personal use, but please don't copy, reproduce, alter, republish, or otherwise reuse any of it - including our artwork and designs - without asking us first. Unauthorised use of our designs may be treated as a breach of copyright law.
Our name, logo and any product names are our trademarks and shouldn't be used without our written permission. The same goes for Wix's own branding, which remains theirs.
Third-Party Tools and Links
From time to time the Services may give you access to tools or features provided by other companies, which we don't control or monitor ourselves. These are offered as they are, without any promises from us, and any use of them is at your own risk - it's worth checking the relevant provider's own terms before relying on them.
Similarly, our site may link out to other websites we don't run. We're not responsible for their content, and if you choose to visit them, you do so at your own risk. Any issues with a third-party site or service should be taken up directly with them.
Our Relationship With Wix
Cottage Art & Design uses Wix to build, host and run our online shop. Any purchase you make, though, is a transaction between you and us - not with Wix. Wix isn't responsible for anything arising from your order or your relationship with us as a customer.
Your Privacy
Any personal information you share with us is handled in line with our Privacy Policy hwww.cottageartanddesign.com/privacy-policy. Because our site runs on Wix, some of your information is also processed by Wix in order to keep the Services running and secure our Privacy Policy explains this in more detail, and by using the Services, you're confirming you've had the chance to read it.
If You Share Feedback
If you ever send us ideas, reviews, suggestions or other feedback, you're giving us permission to use, adapt and share that feedback freely, including for promotional or commercial purposes, without any obligation on our part to credit, compensate, or respond to you.
By sending us feedback, you're confirming it's genuinely yours to share, that you've told us about any incentive you received for giving it, and that it doesn't break any laws or infringe anyone else's rights - including that it isn't offensive, unlawful, or harmful in any way. We're not obliged to keep, act on, or reply to feedback, though we're always glad to hear from you.
Mistakes and Updates
Every so often, something on the site might be wrong - a typo, an outdated price, an incorrect description. We reserve the right to correct these, and to update, change or cancel an order where something was inaccurate, even after you've placed it.
Using the Site Fairly
We ask that you only use our Services lawfully and in good faith. That means not using the site to break the law, infringe anyone's rights (including ours), harass or mislead others, send spam, spread false information, or otherwise cause harm or disruption to us or other visitors.
Please also don't try to copy or exploit our content for your own commercial use, collect other people's personal information through the site, or attempt to interfere with the site's security or normal running. We may suspend or close your account, without notice, if we believe these Terms have been broken.
Bringing Things to an End
We may end this agreement, or your access to the Services, at any time and at our discretion, without notice - though you'll remain responsible for anything owed up to that point.
Certain parts of these Terms will naturally continue to apply even after things end between us - including those covering intellectual property, feedback, liability, and anything else that reasonably should carry on.
A Note on Liability
Everything on our site is provided for general information, and while we do our best to keep it accurate, we can't promise it's always complete or error-free - any reliance you place on it is at your own risk.
Our products and Services are provided as they are and as available, without guarantees beyond what's expressly stated here or required by law, including as to quality, fitness for a particular purpose, or uninterrupted access. Some of this may not apply if the law where you live doesn't allow such limits.
To the fullest extent the law allows, Cottage Art & Design and anyone working with us not liable for indirect, incidental or consequential loss arising from your use of the Services or our products - including lost profits, lost data, or similar losses - even where we've been made aware such loss was possible.
Indemnity
If a claim arises from your breach of these Terms, your misuse of the Services, or your breach of someone else's rights, you agree to cover any resulting losses, damages or reasonable legal costs owed to a third party as a result. We'll let you know if such a claim comes up, and may take the lead on defending or settling it - though we won't settle in a way that requires anything further from you without your agreement.
If Part of These Terms Doesn't Hold Up
Should any part of these Terms be found unenforceable under the law, the rest will continue to apply as normal, with that part read to be as effective as possible within legal limits.
The Whole Agreement
If we don't act on a particular right under these Terms straight away, that doesn't mean we've given it up. These Terms, together with any policies we refer to, make up the whole agreement between you and us about your use of the Services, replacing any earlier versions or conversations on the subject.
Passing These Terms On
You're not able to transfer your rights or obligations under these Terms to someone else without our agreement. We may transfer ours, for example if the business changes hands, without needing to notify you first.
Which Law Applies
These Terms are governed by the laws of the UK, and any disputes will fall under the jurisdiction of the courts of the UK.
Headings
The headings used throughout this page are there to help you find your way around and don't affect how the Terms themselves are read or applied.
Changes to These Terms
We may update these Terms from time to time, and the latest version will always be posted here. It's worth checking back occasionally, as continuing to use the Services after changes are posted means you accept the updated Terms.
